CM Trucking Network operates as a dispatching, coordination, and logistics support platform that connects clients with independent operators, drivers, and service providers.

We do not own or operate all vehicles, equipment, or personnel fulfilling services. Operators engaged through our network are typically independent contractors and not employees of the Company.

We facilitate communication, coordination, and dispatching, but do not guarantee availability, performance, or outcomes of any specific operator or service.


2. No Employment Relationship

Nothing in these Terms creates any employment, partnership, or joint venture relationship between the Company and any operator, contractor, or user.

Operators are solely responsible for:

Their own business operations

Licensing, insurance, and compliance

Equipment condition and safety

Taxes, wages, and expenses


3. Service Requests and Availability

Submitting a request does not guarantee service.

All service requests are subject to:

Availability of operators

Scope of work

Location and timing

Operational feasibility

We reserve the right to accept, decline, or modify any request at our discretion.


4. Pricing, Estimates, and Payment Terms

Any pricing provided is:

An estimate unless otherwise agreed in writing

Subject to change based on scope, time, equipment, and conditions

Payment terms may include:

Deposits or prepayment requirements

Net terms (e.g., Net 30)

Additional charges for overtime, delays, access issues, or scope changes

Failure to make timely payment may result in:

Additional fees

Collection actions, including lien rights where applicable


5. Cancellations and Changes

Clients are responsible for providing accurate job details.

Changes to scope, schedule, or location may result in:

Rescheduling

Limited availability

Late cancellations or changes may be subject to:

Cancellation fees

Minimum charges

Reallocation of scheduled operators


6. Operator Performance Disclaimer

While we aim to connect clients with qualified operators, the Company:

Does not guarantee the performance, conduct, or availability of any operator

Is not responsible for delays, damages, or issues arising from operator actions

Does not assume liability for third-party services performed

Any issues related to performance may be reviewed, but operators remain independent parties.


7. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for:

Indirect, incidental, or consequential damages

Delays, missed timelines, or service interruptions

Property damage, loss, or operational disruptions caused by third parties

Loss of business, revenue, or opportunity

In all cases, the Company’s total liability, if any, shall not exceed the amount paid directly to the Company for the specific service in question.

In such cases, the Company reserves the right to delay, modify, or cancel services without liability. The Company will make reasonable efforts to provide alternative arrangements where feasible; however, availability and performance are not guaranteed.
